Survival

Should this Agreement be terminated at any time, the provisions entitled "Indemnification" and "Disclaimer of Warranties; Limitation of Liability" shall survive.

Miscellaneous

This Agreement comprises the entire understanding between the parties with respect to, and supersedes any prior understanding or agreement, oral or written, relating to the subject matter hereof. This Agreement shall be treated as though it were executed and performed in Daytona Beach, Florida, and shall be governed and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. All legal proceedings arising out of or in connection with this Agreement, shall be brought solely in Volusia County, Florida. You expressly submit to the exclusive jurisdiction of said courts and consent to extra-territorial service of process. In connection with any litigation arising out of this Agreement, the prevailing party shall be entitled to recover all costs incurred, including reasonable attorneys' fees, whether incurred during settlement, at trial, or on appeal. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Service is in conflict or inconsistent with this Agreement, this Agreement shall govern. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.

Policies & Procedures

ORDERING: Tombstone offers over 12,000 choices in sizes, styles & colors; ordering with codes directly from our catalog ensures you get exactly what you ordered. Tombstone is not responsible for incorrect ordering. Except for manufacturing defects, "No Returns" is our policy.
Minimum order:
Wholesale Customers - $25 for existing customers; $100 for a first time customer.
Retail Customers: No minimum order

PAYMENT: We accept Visa, Mastercard, American Express or Discover card. We do not accept or process COD shipments on the web (wholesale customers can call us at 386-255-3022 to place a COD order). Retail customers can create your order online, print out appropriate forms and pre-pay for your order with Money Order or Cashier's Check.

SHIPPING: After you place your order it will be shipped the following business day from Daytona Beach, FL via UPS or USPS. Tombstone reserves the right to reschedule shipping to meet business needs. You may choose how quickly you want your package to be delivered. UPS provides Ground, 2day Air and Next Day Air. Saturday delivery is available in certain areas for an additional charge, call for price. AK and HI may be charged additional fees. International delivery is available, call for price.

WARRANTY: "No Returns" is our policy. At times a manufacturing defect may occur. You must call Customer Service at 386-255-3022 (or email custserv@tombstonebodyworks.com) within 48 hours to report a defective product. We will then provide you with a RA number. Only a defective product that has been provided this RA number will be accepted. After Tombstone's verification of a manufacturing defect, your product will be exchanged or your money refunded to ensure complete satisfaction.

BACK ORDERS: Tombstone offers over 12,000 choices in sizes, styles & colors. If a product is out of stock at time of ordering, your Tombstone representative will advise you if a back order can be taken. Retail orders may be held up to 60 days, after that time money will be refunded.

SHORTAGES: Should a discrepancy in your package occur, you must call Customer Service at 386-255-3022 (or email custserv@tombstonebodyworks.com) within 48 hours. We will do our best to ensure your complete satisfaction.

UPS SHIPPING NOTES:
- UPS DELIVERS MONDAY-FRIDAY 8AM-8PM. Check with your local driver or hub for delivery times.
- Saturday, Sunday & Holidays are not counted as delivery days.
- We place a "Deliver after 1pm" sticker on every package as a courtesy to you. It does not guarantee UPS will deliver after 1pm.
- All returned packages are charged shipping and handling plus a 10% restocking fee. This debit must be paid for by credit card or money order before additional orders can be made.
- All packages will be shipped UPS or USPS and include insurnace and delievery confirmation charges. No exceptions.
